Proposed Cato Ridge Land Use Options Project: Water Use License Application
The Cato Ridge Development Company (CRDC) (the Applicant), a wholly owned subsidiary of Assmang Limited, applied for a Water Use License, to undertake water use activities in term of Section 21(c), (g), (f) and (i) associated with the development of the Cato Ridge Land Release Project. The project entails the establishment of bulk infrastructure required to service the full extent of this mixed-use development.

Appeals arising out of the integrated water use licence applications
21. (1) An applicant or a person who objected to an application and who is aggrieved by a decision of the responsible authority on a water use licence application, arising out of the integrated process contemplated in section 41(5) of the Act may lodge an appeal to the Minister, as contemplated in Regulation 22.
(2) Any appeal other than an appeal contemplated in sub- regulation (1) must be lodged and dealt with in accordance with section 148 of the Act.
Submission of appeal to Minister
22. (1) A person contemplated in regulation 21(1) must submit a notice of intention to appeal in accordance with Annexure F, to the Minister, within 30 days of becoming aware of the decision or of being provided with reasons for the decision.
(2) The Minister, may, in writing, and on good cause shown, extend the period within which a notice of intention to appeal must be submitted.
The Cato Ridge Development Company Ltd (“CRDC”) and Assmang (Pty) Limited (“Assmang”), proposed to release land parcels across three (3) Proposed Development Areas (Figure 1). The intention is to make land available for a combination of land use options in the Cato Ridge area for future developers to develop / construct. The proposed project is located within the eThekwini Metropolitan Municipality, KwaZulu Natal. Zutari (Pty) Ltd (“Zutari”) has been appointed as the Environmental Assessment Practitioner (EAP) to undertake the regulatory Environmental Impact Assessment (EIA) process, and Phelamanga has been appointed to assist and facilitate the Public Participation Process (PPP).
While CRDC/Assmang are the applicants for the Environmental Authorisation (EA) process and the Water Use Licence, the land will be made available for sale to the respective developers going forward. Each future development will require a detailed legal review to ensure alignment of the site-specific EIAs with the conditions of Environmental Authorisation and the Environmental Management Programme (EMPr) for this project. Additional permits and licenses that may be required for the final land uses remains the responsibility of the future property owner and developer.
The Water Use License Application Public Participation process has concluded and the license granted by the DWS.
